 Client was in prison facing deportation.

Client’s Situation

Ms B was facing deportation. Her asylum and human rights claim was refused and certified with no right of appeal. We challenged this decision by Judicial Review and then appealed the decision to deport.

LUPINS represented Ms B in her appeal and assisted in providing various corroborating evidence including medical evidence and country report in support of her human rights appeal.

Our Action

We assisted the client from the outset, advising her on the asylum process, judicial review application and human rights appeal. We also secured our client’s release from detention. Her asylum and human rights appeal was allowed on appeal to the Upper Tribunal. We also identified that our client had a negligence claim against the prison service and made further referrals.

The Result

The appeal was allowed on all grounds and our client was granted Leave to Remain in the UK as a Refugee.
