Mr E sought our help, after his appeal, had been dismissed by the Upper Tribunal. His previous representatives had made an application for him to be granted leave under Appendix FM, ex1 (10 year route to settlement). The Judge was not satisfied that he could not relocate with his family in the country of origin.
When he instructed us, it became apparent that the previous representatives had not identified that the income the wife was receiving in the form of a bursary for her studies, coupled with savings in his country of origin, were going to be sufficient for him to make an application to be granted leave under the 5 year route to settlement.
Mr W was granted a leave to remain as the spouse of a person settled in the UK under the 5year route to settlement.
