Immigration application as an elderly dependant under the appendix FM

Client’s Situation

The Client approached LUPINS in making an application for her mother to join her from Nigeria as her elderly adult dependant.  The client’s mother was age over 65 and in a Wheel chair.

Our Action

We submitted an application for entry clearance on client’s behalf. We submitted that the client’s mother has no one in Nigeria to offer her care and support. We gathered the documentary evidence required, prepared statements and submitted the application on line. The entry clearance officer refused the application and did not attach any weight to the submissions made on our client’s behalf. We challenged that decision and appealed to the first Tier tribunal.

The Result

We succeeded at the first Tier Tribunal, the Immigration Judge accepted our argument that our client’s mother was an elderly person in need of care and there were no care arrangements available for her in Nigeria.
